Welcome to Plant Wagon Store ("Company," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your use of www.plantwagonstore.com (the "Site"), any related mobile applications, and the purchase of products and services offered through them (collectively, the "Services"). By accessing or using our Services you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Services.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract under applicable law to use our Services. By using the Services, you represent that you meet these requirements.
2. Account Registration & Security
You may browse the Site without creating an account, but certain features (e.g., order tracking, saved addresses) require registration.
You agree to provide accurate, current, and complete information during registration and keep it updated.
You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.
Notify us immediately of any unauthorized use of your account.
3. Products, Pricing & Availability
Product Descriptions: We endeavor to describe and display products as accurately as possible; however, natural variations in flowers and seasonal availability may cause differences.
Substitutions: We reserve the right to substitute flowers, containers, or accessories of equal or greater value if necessary to fulfill your order (e.g., due to seasonality).
Pricing: Prices are listed in U.S. dollars and are subject to change without notice. Taxes and delivery fees are calculated at checkout.
Errors: If a product is listed at an incorrect price due to typographical or system error, we reserve the right to refuse or cancel orders placed for that product, even after an order confirmation.
4. Orders & Payment
Order Acceptance: Your order constitutes an offer to purchase; we are not obligated to accept until we dispatch the product and send a shipment confirmation email.
Payment Methods: We accept major credit cards, debit cards, PayPal, Apple Pay, and other methods displayed at checkout. You authorize us to charge the payment method you provide for the total amount (including applicable taxes and fees).
Sales Tax: We collect sales tax as required by U.S. law based on the delivery address.
Cancellations & Changes: To cancel or change an order, contact Customer Support at least 24 hours before the scheduled delivery date. Custom or same‑day orders may not be cancelable.
5. Delivery & Risk of Loss
Delivery Areas: We deliver across the United States, subject to serviceable ZIP codes listed on the Site.
Delivery Windows: Standard, same‑day, and scheduled delivery options are offered where available. Times are estimates.
Recipient Availability: If no one is available to receive delivery, we may leave the arrangement at the recipient’s door, with a neighbor, or per other instructions. Risk of loss transfers to you upon delivery or attempted delivery.
Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control (e.g., weather, natural disasters, strikes, pandemics).
6. Returns & Refunds
Fresh floral products are perishable. If you are dissatisfied with your order, contact us within 48 hours of delivery with a photo and order number. At our discretion, we may offer a replacement or refund. Non‑perishable items may be returned within 14 days, unused and in original packaging. Return shipping costs are your responsibility unless the item was defective.
7. Promotional Codes & Loyalty Programs
Promotional codes must be entered at checkout and cannot be applied retroactively. Codes may not be combined unless stated. Loyalty points have no cash value and may expire per program terms.
8. Intellectual Property
All content on the Services—text, graphics, logos, images, audio, video, software—is owned by or licensed to the Company and protected by U.S. and international intellectual‑property laws. You may not copy, distribute, modify, or create derivative works without our written permission.
9. Prohibited Conduct
You agree not to:
Use the Services for any unlawful purpose.
Post or transmit harmful, defamatory, or infringing content.
Interfere with or disrupt the Services or servers.
Use bots, scrapers, or other automated means without our prior written consent.
10. User Content
If you submit reviews, photos, or other content ("User Content") you grant us a worldwide, perpetual, irrevocable, royalty‑free, sublicensable license to use, display, reproduce, and distribute such content in any media. You represent that you own or control all rights to your User Content.
11. Disclaimers & Limitation of Liability
THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOST PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTly, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF THE SERVICES OR PRODUCTS; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS; OR (C) ANY VIRUSES OR HARMFUL CODE TRANSMITTED VIA THE SERVICES.
Some jurisdictions do not allow the exclusion or limitation of certain damages; the above limitation may not apply to you.
12. Indemnification
You agree to defend, indemnify, and hold harmless the Company and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your violation of these Terms or your use of the Services.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to conflict‑of‑law principles. Any dispute arising under these Terms shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules in Wilmington, Delaware. The arbitrator’s decision shall be final and binding. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS.
14. Changes to Terms
We may revise these Terms from time to time. We will post the updated Terms on the Site with the “Last updated” date. Your continued use after such changes constitutes acceptance.
